List Rental Agreement

The List may not be copied or duplicated in any fashion. The Customer will take reasonable precautions to see that this requirement is met and assumes all liability for damages associated with any violation.

The purchased List contains unique, proprietary information, and is the sole and exclusive property of SciData.

Customer shall not release, copy, alter, assign, transfer, sell or extract data from the List for any purpose, and shall not publish the List or any portion of it in any form. Customer shall not use the List for solicitation of any kind, solicitation of funds, or data collection.

The Customer, when using the List, will ensure they abide by all national, state and federal regulations in respect of email and postal mailing and the mailing content, and shall indemnify and hold harmless SciData against any claim, damage, expense, liability, or obligation incurred by reason of use of the List.

The Customer understands that List counts vary daily due to ongoing list maintenance, and that some email and postal addresses become non-viable over time due to individuals changing employer, changes in domain names, spam filters and other reasons. SciData assumes no liability if the counts ordered differ from the counts received, or cannot guarantee the accuracy of mailing addresses or numbers as individuals and organisations change their details regularly. By using the List, the Customer accepts all costs associated with returned mail.

This Agreement is governed by and construed in accordance with the laws of India. Any disputes arising out of this Agreement that cannot be resolved between the parties will be brought before a court located in the State of Kerala, India.
